By using our Services, you understand and agree that we are providing a platform for you to post content, including photos, comments, images, create voice messages, translate videos, clone your voice (for the purpose of Translating YOUR voice messages) and various other communications (“Content”) for use with our Services and Softwares and other users. You understand and agree that other users may search for, see, use, comment on or share your Content that you make publicly viewable through the Services, consistent with these Terms of Use and Privacy Policy.
Privacy Policy Consent
Use of the data that you provide to us, or which is collected by us on or through our Services is governed by this Privacy Policy. By using or purchasing our Services, you agree and consent to this Privacy Policy, including any updates or changes that may be made to this Privacy Policy from time to time.
We advise that you review this Privacy Policy from time to time as you are bound by it implicitly through your use of our Services, regardless of whether you have read them.
Submission, Storage and Sharing of Personal Data
What We Collect. We may seek personal data including your name, e-mail address, phone number and your recorded voice as well as other contact information, namely when you access or use our Services. By providing such information to us, you grant us permission to use and store such information. We, in turn, will use our best efforts to keep such information safe and secure.
We may collect the following information:
(1) Your first and last name, username, password and e-mail address when you register for an account.
(2) Your contact information including but not limited to a photo of you, your phone number, and residential address.
(3) Demographic information such as gender, country, age, preferences and interests to help you or other users find your profile and Content.
(4) Your voice, ‘specifically for cloning for YOUR personal voice message translations’ that you create and that you use and share privately and publicly.
(5) Your Content, including but not limited to, photos, video’s, comments, communications and other materials that you post or share through our Services.
(6) Other information or communications with us related to your account or our Services, including but not limited to account verification, changes or updates to features of our Services, technical and security notices which you may not opt out of.
If you believe that any information we are holding on you is incorrect or incomplete, please contact us as soon as possible. We will promptly correct any information found to be incorrect.
How We Use the Information We Collect. We request and require various personal data to understand your needs and provide you with a better service. In addition, we may gather such information for the following reasons: (1) to use for internal record keeping to monitor demographic patterns, traffic patterns, and the quantity of users, (2) to help you quickly and easily access your profile and Content after you sign into your account, (3) to help you remember information so you will not have to re-enter it upon subsequent use of our Services; (4) We clone your voice specifically for ‘your own personalised use’ within our Application and to make the speed of rendering your Language translated messages & videos much faster. (5) to test, monitor and determinate the effectiveness of our Services, (6) to periodically send promotions about new Services or other special offers from which you may unsubscribe at any time, (7) to gather information for aggregate, non-identifiable data for market research purposes, (8) to customize our Services by providing personalized content and information to you and other users such as advertising or marketing, (9) to improve our Services and develop and test new features, (10) to diagnose or repair technology issues; and (11) to provide automatic updates to the application on your mobile device.
Storage. All information is stored through a data management system(s) and may be stored and processed in any country of our choice in which we, our affiliates or service providers are located for a commercially reasonable time that allows for backup, archival and/or audit purposes. This information can only be accessed by those who help manage that information, in order to deliver e-mail or otherwise contact you if you do not opt out of receiving our communications. By registering to access and use our Services, you agree and acknowledge that we and those who manage the data management system may have access to your personal, identifying information and we may transfer or share that information across borders from your country or jurisdiction to other countries or jurisdictions worldwide, including the United States and the European Union. If you are located in the European Union or other regions with laws governing data collection, you consent to us transferring your data to other countries or regions which may or may not have the same data collection laws as the country in which you are located.
Sharing of Information by Us. All information collected by us will be held in confidentiality and will not be rented, sold, or disclosed to third parties without your consent, except that we may disclose personal information: (1) pursuant to the Terms of Use and this Privacy Policy, (2) if we are required to do so by law in any jurisdiction consistent with internationally recognized standards, (3) in the good-faith belief that disclosure is necessary to conform to the edicts of the law, (4) to comply with legal process served on us, our partners, sponsors, investors, or affiliates such as a search warrant, subpoena or court order for as long as required pursuant to the request, (5) to protect and defend our rights or property or those of our users, (6) to act as immediately necessary in order to protect the personal safety of our users or the public, including but not limited to detecting, preventing, investigating or addressing fraud, imminent bodily harm or other potentially illegal activity or violations of our terms and policies, (7) to other affiliates, advertisers, marketing partners or service providers who help to provide, understand, complement, and improve our Services or targeted advertisements provided that they respect, honor and comply with the privacy preferences you have indicated as shown in your user account. We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so. Should our Company or assets be otherwise sold or transferred to a third party, in whole or in part, through such transaction including but not limited to a merger, acquisition, bankruptcy, dissolution or liquidation, your identifying information and Content may be sold and transferred as a result, but you will retain ownership to your Content and the buyer or transferee will be legally obligated to honour the commitments and terms we have set forth in our Terms of Use and Privacy Policy until future notice of any changes.
Sharing of Information by You. Any information that you voluntarily disclose, post or share through our Services, including but not limited to your profile, account, communications, Content or any information otherwise related to you (“Your Information”), becomes available to other users inside the application. You agree and understand that once you have shared Your Information and made it public that it may be searched and re-shared by other users and we are not in any way liable or responsible for your sharing of such information. You also recognise that the use and sharing of Your Information is subject to our API Terms of Use. You also recognise that if you remove Your Information, copies may remain viewable in cached and archived pages of the Services or if other users or third parties have copied or saved such information and you consent to such use and/or storage.
Viewing by Other Users, “Friends” and Third Parties. Whenever you make your personal profile or identifying information available for viewing by other users or third parties through our Services, the information you share also can be seen, collected and used by other users and third parties, and therefore, we cannot be responsible for any unauthorized third party use of such information that you voluntarily share through our Services, online or in any other manner. Should you choose to use our “Find Friends” feature to locate other users, there are three ways in which you may find and access their information: (1) Through your own device’s contact list, by which you consent to us accessing your contacts list to determine whether or not one of your identified contacts is using our Services; (2) Through a third party social media site, by which you consent to establishing a link to the third party social media site and exchanging information; or (3) Through a search of current users by name or username, by which you consent to typing a name to search for a user and allowing us to perform the search and generate results from the search. Should you choose to use our “Find Friends” feature, you may select an individual from your social media contact list and contact them through your account, and you understand and agree that you are solely responsible for any data charges that apply to communications sent from your mobile device, and that we do not have any ability or access to control such communication as it is being generated from your social media account.
Cookies. A cookie is a small file which asks permission to be placed on your computer’s /mobiles hard drive. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular website. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.
Like most companies, we use traffic log cookies and similar tools such as pixels, web beacons, and local storage to identify what information is being used and accessed by our users. This helps us analyse data about web page traffic and improve our website, App and Softwares in order to tailor it to our users. We only use this information for statistical analysis purposes and then the data is removed from the system.
Overall, cookies help us provide you with better Services, by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us.
We may invite advertisers or other partners to serve ads or services to you which may use cookies or similar tools placed by us or the third party.
You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer, but it may prevent you from taking full advantage of our Services.
Analytics. We use third party analytics and tools to help us measure traffic and usage trends for our Services. These tools collect information sent by your device or our Services, including the website pages you visit, add-ons, and other information that assists us in improving our Services. We collect and use this analytics information in the aggregate with analytics information from other users so that we cannot reasonably determine the identity of any particular individual user.
Log File Information. Log file information is automatically reported by your browser each time you make a request to access or visit a website page or application, and can be provided when the content of the webpage or app is downloaded to your browser or mobile device. We collect log file information to provide more accurate reporting and improvements to our Services. When you use our Services, our servers automatically record certain log file information, including your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Services, domain names, landing pages, pages viewed, and similar information. We may also collect similar information from emails sent to our users which help us track user behaviour patterns related to our Services.
Mobile Device Identifiers. To gather information about your browser patterns and how you use the Services, we use mobile device identifiers to help generate reports. When you use a mobile device like a laptop, tablet or phone to access our Service, we may access, collect, monitor, store on your device, and/or remotely store one or more device identifiers which are small data files or structures stored on or associated with your mobile device, which uniquely identify your mobile device. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device’s operating system or other software, or data sent to the device by us. Some features of our Services may not function properly if the use or availability of the mobile device identifiers is impaired or disabled.
Metadata. Metadata is technical data that is associated with your user Content that can, among other things, describe how, when and by whom user Content was collected and how that Content is formatted so that your Content is more searchable by other users. You can add Metadata to your Content including but not limited to use of a hashtag to mark keywords when you post a photo, geotag to mark your location in connection to a photo, comments or other data. If you geotag your photo, your latitude and longitude will be stored with the photo and will be searchable through a location or map feature if your photo is made public by you through your privacy settings. If you receive information about contests, offers, or other events or activities (“Events”) from other users through the Services, you may choose not to use the hashtag or geotag associated with the Events to keep your location untagged.
Passwords
To use certain features of our Services, you may be permitted to create a unique username and password, which you will receive through your registration process. You are responsible for maintaining the confidentiality of the password and account, and are responsible for all activities (whether by you or by others) that occur under your username, password or account.
You are not permitted to share your username and/or password with anyone. If we learn you have shared your username and/or password with any other individual or entity, we reserve the right to immediately terminate your access to our Services.
It is your responsibility to protect your own password from disclosure to others. We cannot and will not be liable for any loss or damage arising from your failure to protect your password or account information. You are responsible for activities that take place using your password and within your account. If you share your password with anyone, they may be able to obtain access to your personal information at your own risk.
You agree to notify us immediately of any unauthorized use of your password or account or any other breach of security, and to ensure that you exit from your account at the end of each use.
By using our Services, you agree to enter true and accurate information as part of the registration process and otherwise. If you enter a false e-mail address, we have the right to immediately inactivate your account.
While we use commercially reasonable safeguards to help keep the information we collect secure and take reasonable steps, such as providing you with the opportunity to create and change your password, to verify your identity before granting you access to your account, we cannot ensure the security of Your Information or password, or guarantee that Your Information or password, may not be accessed, disclosed, altered, or destroyed. We will use our best efforts to keep your password private and will not otherwise share your password without your consent, except as necessary when the law requires it or in the good faith belief that such action is necessary, particularly when disclosure is necessary to identify, contact or bring legal action against someone who may be causing injury to others or interfering with our rights or property.
Should you choose to link to social media site or other third party websites through our Services, your privacy settings may be affected, and you understand and agree that we are not responsible for the privacy, functionality, or security measures of any social media site or other third parties.
Unsubscribe
You may unsubscribe to our e-mail communications or updates at any time through the unsubscribe link at the footer of all e-mail communications. However, you may not opt out of service-based communications related to and including but not limited to account verification, changes or updates to the Services or its features, technical notices, or security notices.
Anti-Spam Policy
We have taken the necessary steps to ensure that we are compliant with anti-spam legislation by never sending out misleading information to you or our users. We have a no spam policy and provide you with the ability to opt-out of our communications, with the exception of service-based communications as described in this Privacy Policy by selecting the unsubscribe link at the footer of all e-mails.
Children’s Online Privacy Policy
We do not knowingly collect or solicit any information from anyone under 13 years of age or knowingly allow such persons to register for an account or use our Services. Our Company and Services are all directed to individuals who are at least 13 years old or older. If we discover that we have collected personal identifying information from a child under age 13 without parental consent, we will delete that information as quickly as possible.
